Terms and service conditions

1. Object of the contract

These terms govern the SIVEVIS “Website as a Service” provided to the client. The service includes website design, development, hosting and maintenance in exchange for a monthly subscription. The subscription also includes five SEO-focused content pieces per month, initial keyword research and content planning, and search-visibility and analytics reporting through the configured tools. You may browse this site and contact SIVEVIS for lawful purposes. Do not interfere with its operation or security, attempt unauthorised access, introduce malicious code, reverse-engineer technical controls, scrape content at scale without permission, or use content in a way that infringes rights. A paid service begins only after a written order is accepted.

2. Pricing and payment

The subscription costs €50 per month plus applicable IVA. The monthly amount is billed in advance at the beginning of each month using the payment method agreed with the client, such as a payment card or direct debit. IVA is added at the legally applicable rate; a change in tax law affects only the tax amount required by law. The €50 monthly base fee is fixed during the initial 12-month minimum term. After that term, SIVEVIS may review the base fee once in each 12-month period by reference to the Spanish Consumer Price Index (IPC) published by the INE, subject to a maximum increase of 5% in any review period. SIVEVIS will give the client at least 60 days’ written notice stating the new amount, the calculation and the effective date. The new fee will apply only from the next renewal date and will not apply retroactively. The client may cancel before the effective date without an early-termination charge. Approved additional work, third-party charges and changes to IVA are separate from the base-fee review. The accepted written order and the related invoices are the contract records.

3. Duration, permanence and cancellation

The minimum contract period is 12 months from the launch of the website. If the client ends the service before that period expires, the unpaid monthly installments for the remaining minimum term become due as an agreed early-termination charge, subject to mandatory consumer rights. The website will go offline when the service ends. After the first 12 months, the contract renews automatically month to month and may be cancelled with 30 days’ written notice to hello@sivevis.com. SIVEVIS may offer an optional €490 exit package to export the agreed website materials and source package; it does not transfer third-party licences or hosting accounts unless expressly agreed.

4. Intellectual property, domain and hosting

The client retains full ownership of all texts, images, logos and domain names supplied to SIVEVIS. The client must register and keep the domain in the client’s own name; SIVEVIS may manage DNS and technical access only as authorised to deliver the service. The website code, design structure, templates and technical infrastructure remain SIVEVIS property. The client receives a licence to use the website while the subscription is active. Hosting and the hosting account remain under SIVEVIS’s operational control while the service is active. Copying, sublicensing, reselling, reverse-engineering or using the website or SIVEVIS framework to create a competing service is prohibited. The optional exit package described above is the route for an agreed export or source-code transfer.

5. Service level and edits

The website is targeted to be ready within three business days after SIVEVIS receives all necessary content and access from the client. The subscription includes up to one hour of content updates per month, including text and image changes. New pages or features are separate work billed at €40 per hour after prior written approval. Third-party subscriptions, payment or booking systems, photography, additional copy or translations and legal review are also separate unless expressly included in the accepted order.

6. Non-payment and debt recovery

If a monthly payment fails, SIVEVIS may temporarily suspend the website, hosting, edits and support after seven days. If payment is not received within 30 days, the website and all data may be permanently deleted from SIVEVIS servers. SIVEVIS may send a formal written demand, claim applicable late-payment interest and reasonable recovery costs where permitted, and use Spain’s procedimiento monitorio or another lawful debt-recovery procedure. The client should request and secure any required copy before deletion and arrange replacement hosting if it wants continuity.

7. Client duties, acceptable use and capacity

The client must provide accurate information, lawful content, necessary rights and timely approvals; keep domain and business credentials secure; identify required personal-data processing; and remain responsible for its claims, prices, opening hours, regulated information, accessibility decisions and compliance obligations. The service is for the client’s own business use. Web-design agencies, SEO agencies, marketing agencies, resellers, white-label operators and competitors may not order, access, copy, benchmark or resell the service or SIVEVIS framework unless SIVEVIS agrees in writing. Copying, scraping, reverse-engineering, circumventing technical controls, creating derivative competing products and abusive or unlawful use are prohibited. SIVEVIS may decline an order, limit the number of new clients accepted each month, or suspend/refuse service where capacity is full, a conflict exists, or misuse is suspected.

8. Data protection and service exit

Where SIVEVIS processes visitor or lead data for the client, the client is normally controller and SIVEVIS processor under a written data-processing addendum. The addendum governs security, instructions, subprocessors, breach assistance and the return or deletion of client data when the service ends, subject to lawful retention. Each client website must publish its own privacy and cookie information. SIVEVIS does not use client personal data for its own marketing. SIVEVIS does not guarantee search rankings, traffic, leads or sales, and third-party services may experience outages. Nothing excludes liability that cannot legally be excluded or mandatory consumer rights.

9. Jurisdiction

These terms are governed by Spanish law. To the extent legally permitted, the parties submit disputes to the courts of Gijón, Asturias. Mandatory consumer jurisdiction rules prevail where applicable.

10. Language and changes

This English page is a translation for convenience. The Spanish version is the only prevailing version; if the texts differ, the Spanish text prevails. The version published here applies to new orders, while an accepted order and its agreed scope control the relevant subscription.
